Probate

Probate is a process whereby the Supreme Court of Queensland examines the deceased’s Will and ensures it is the last legally valid Will.

It confirms that the executor named in this Will has authority to deal with the estate of the deceased person.

If a deceased person has assets that are being held by an entity on their behalf (i.e money in a bank account), this entity will often not release these assets unless they are provided with Probate.

Each entity that holds assets on behalf of a deceased person will have their own processes and procedures regarding this.

If you are unsure whether you will need a grant of Probate, you should contact any entities that hold any assets on behalf of the deceased person
