Don’t get caught in the queue

This is the story of a personal acquaintance.

B and I were members of a committee for about five years. Her parent’s passed in about June 2021. I did offer my services however she decided to stay with the law firm where her parents had made their wills. Whilst an executor is free to instruct whomever they choose, some people feel obliged to retain the firm that did the will. In this case it was an older regional practice.

"Hi Caroline, xxxxxxx, however, not why I am emailing you. Hope you do not mind my asking you a legal estate question or two. Is there any reason to transfer our parents house into the our names? Can we sell the house in their name and the money go to the estate. Can the money sitting with the lawyers be distributed now or does it stay there until the sale of the house. I am now regretting staying with my parents solicitor. Hope this email finds you well.

B"

We set up a complimentary call the following day:

• A one minute eCourts search revealed that Probate had been granted in October 2021 , some 4 months after the date of death
• The bank funds were recovered in February 2022
• The house was sitting vacant and B did not know the current status of the title
• Limited communication available from the firm despite attempts to confirm the status of the estate

I provided B with more useful information in 20 minutes than they had gotten out of the lawyers with the file in 4 months. I offered her the best legal solution, a quote and the time frame I would complete the work

We would have had this estate settled in full by October 2021. Unfortunately the beneficiaries at at the time of writing this case study were still waiting for their inheritance.

If you want to avoid having your estate file gather dust on the shelf then we invite you to book a discovery call today.

We guarantee a Probate specialist will look after you and your client journey will be exceptional.
